TN Visa for Mexican and Canadian Professionals Under NAFTA

The North American Free Trade Agreement (NAFTA) has opened doors for professionals from Mexico and Canada who wish to work in the United States. The TN visa is a unique opportunity for accountants, engineers, lawyers, pharmacists, scientists, and teachers, among others, to practice their profession in the U.S. temporarily. Here we explain what you need to know about this type of visa.

Eligibility and Process for Canadian Citizens

Canadian citizens have a more straightforward process, as they generally do not require a visa to enter the U.S. When seeking admission under the TN category, they must present evidence of Canadian citizenship and a letter from the U.S. employer to the customs officer at a port of entry. This letter should include job details, duration of stay, and educational qualifications. A petition can also be filed through the employer using Form I-129.

Requirements for Mexican Citizens

Unlike Canadians, Mexicans must obtain a TN visa at a U.S. embassy or consulate in Mexico. Upon visa approval, they must present the necessary documents at a port of entry to be admitted as TN nonimmigrants.

Period of Stay and Extensions

The TN visa is initially granted for up to 3 years. To extend the stay, employers can file Form I-129 on behalf of the worker. Professionals can also exit and re-enter the U.S. by presenting the same documentation as in their initial admission.

Dependents of TN Nonimmigrants

Spouses and children under 21 can obtain TD nonimmigrant status. Although they cannot work in the U.S., they are permitted to study. The stay for dependents does not exceed that of the TN visa holder.

The TN visa represents a valuable opportunity for Mexican and Canadian professionals looking to advance their careers in the United States. It is important to understand the specific requirements and procedures for each nationality and to stay informed about changes in regulations. Seize this opportunity to grow professionally and experience the American way of life!
